Confidentiality Rules

We take the protection of your personal data seriously. The purpose of this Privacy Policy is to inform you about the type of personal data that will be collected when you use our website and how we process, use, and protect such data.

1. PRIVACY

The Web user's personal data is collected and processed by MW as the data controller within the meaning of the regulations applicable to the processing of personal data (including in particular the General Data Protection Regulation 2016/679). MW collects the surname, first name, e-mail address and telephone number of Web users in order to send them the information they request, in particular on MW's creations. This data will also be used to monitor the use that the Web user makes of this information and, if necessary, to make proposals to the web user in relation to this information.

No personal data of a web user will be transmitted to a third party for commercial or marketing purposes without his/her permission. The data collected may be transmitted to third parties (IT service providers, hosts, etc.) in order to respond to the web user's requests, insofar as this is necessary for the purposes set out above.

However, the data provided will not be transferred to a country outside the European Union. The data is kept for the time strictly necessary to fulfil the purposes for which it was collected. Under the conditions and within the limits provided for by the applicable regulations, the Web

MW shall bear no liability in any event to make reparation for any direct or indirect damage suffered in connection with the access or use of the Website or information and content provided by MW, including operating losses and business losses, and more generally, any damage that is not due solely and directly to MW’s default.

EXCEPT SOLELY FOR ANY WARRANTIES EXPRESSLY IDENTIFIED HEREIN AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MW PARTY WAIVES ALL WARRANTIES EXPRESSED OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR INTENDED USE OF THE WEBSITE OR INFORMATION OR CONTENT PROVIDED BY MW HEREUNDER. THE WEBSITE IS PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS. IN PARTICULAR, BUT NOT BY WAY OF LIMITATION, MW DISCLAIMS THAT THE WEBSITE, THE CONTENT OR THE INFORMATION IS PROVIDED ERROR FREE.

3. SUSPENSION OF THE WEBSITE

MW shall use its best efforts to maintain the quality of its services and for that purpose, shall perform on a regular basis remedial maintenance or enhancement operations on the Website. During such operations, access to the Website may be more difficult or impossible. MW shall bear no liability for any damage whatsoever that may be caused by such suspensions. MW shall not be bound in any event to allow access to the Website in case of force majeure, which shall mean, in accordance with the French case-law, any unforeseeable and irresistible event outside its control, such as strike, adverse weather, embargo, failure of power supply or internet network, malfunction of satellites, or breach of their obligations by internet service providers.

4. GOVERNING LAW AND JURISDICTION

These T&C shall be governed by French law. Regardless of the applicable law, no effect is given to conflict of law provisions.  Any dispute relating to these T&C shall be subject to the sole jurisdiction of the Paris Court, including in the event of third-party claim, plurality of defendants, summary or unilateral proceedings.
